Neverland ("we", "our", "us") respects your privacy. This Privacy Policy explains how we collect, use, store, and protect your information when you use the Neverland mobile application ("App").

1. Information We Collect

Images and Face Data

  • Users may upload images that contain faces. These images are processed solely to provide AI-generated image and video transformations requested by the user. We do not extract, analyze, or store biometric identifiers, facial recognition templates, or face geometry data.

a. Information You Provide

  • Photos and images you upload for AI generation
  • Account information (such as user ID)
  • Support requests or communications

b. Automatically Collected Information

  • Device information (OS version, app version)
  • Usage data (feature interactions, generation activity)
  • Purchase and subscription status

c. Payments

  • All payments are processed by Apple App Store or Google Play.
  • We do not collect or store your payment card information.

2. How We Use Your Information

We use your information to:

  • Generate AI images and content
  • Provide and improve app functionality
  • Manage credits, subscriptions, and purchases
  • Store and deliver generated results
  • Detect abuse, fraud, or misuse
  • Moderate content and enforce Community Guidelines
  • Process user reports and safety concerns
  • Comply with legal obligations

Uploaded images, including those containing faces, are used only to perform AI-based visual transformations initiated by the user. Face data is not used for identification, tracking, profiling, or advertising purposes.

3. AI Image Processing

  • Processing may involve third-party AI providers
  • Images are not used to train public AI models
  • Generated content is linked to your account

4. How We Handle Face Data and Photos

Neverland is an AI photo and video transformation app. This section explains how we collect, process, store, and delete photos containing faces and facial data.

a. What Face Data We Collect

  • Photos and videos you upload: When you select photos or videos for AI transformation, those files may contain faces. We collect only the specific images or videos you choose to upload—we do not automatically access or upload your entire camera roll.
  • Face detection metadata: We use on-device face detection (via iOS Vision framework) to validate that your photo contains a detectable face before uploading. This includes information about face position, size, and quality.
  • Face characteristics for AI processing: Once uploaded, our AI systems analyze facial features in your photos to apply transformations (e.g., style changes, filters, artistic effects). This analysis occurs automatically as part of the generation process.

Important: Face detection validation occurs on your device. The actual face data (your photos containing faces) is uploaded to our secure cloud storage for AI processing.

b. How Face Data Is Used

We use face data solely to provide you with AI photo and video generation features. Specifically:

  • Quality validation: On-device face detection ensures your photo meets quality requirements (e.g., face is visible, properly sized, not too blurry)
  • AI transformation: Cloud-based AI systems process your photos to apply the selected style pack or transformation
  • Result delivery: Generated AI photos and videos are stored and delivered to you within the app
  • Service improvement: We may analyze aggregated, anonymized usage patterns to improve our AI models and app features, but we do not use your individual photos to train public AI models

We do not use your face data for:

  • Facial recognition or identity verification
  • Tracking you across other apps or websites
  • Advertising or marketing purposes
  • Selling or sharing with third-party data brokers
  • Training AI models for unrelated products or services

c. Where Face Data Is Stored

  • Original uploaded photos: Temporarily stored on Supabase cloud storage (secure, encrypted storage infrastructure)
  • AI-generated results: Stored on Supabase cloud storage and linked to your account
  • Face detection metadata: Processed on-device and not stored separately; only used transiently during upload validation

Data security: All data is encrypted in transit (HTTPS/TLS) and at rest. Access to your photos is restricted via signed URLs, meaning only you can view your uploaded and generated content.

d. Third Parties with Access to Face Data

  • Supabase: Cloud storage provider that hosts your uploaded photos and generated results. Supabase does not have permission to use your photos for any purpose other than storage.
  • AI processing providers: Third-party AI services that process your photos to generate transformations. These providers process your photos solely to deliver the requested AI generation and do not retain your photos after processing is complete.

We do not share face data with: Advertisers, social media platforms, data brokers, or any other third parties for purposes unrelated to providing the Neverland service.

e. How Long Face Data Is Retained

  • Original uploaded photos: Automatically deleted from our servers within a few days after successful AI generation. We do not retain your source photos longer than necessary to complete the generation process.
  • AI-generated photos and videos: Stored indefinitely until you delete them manually or delete your account. You have full control over your generated content.
  • Face detection metadata: Not retained. This data is processed transiently on your device during upload and is not stored on our servers.

Account deletion: If you delete your Neverland account, all of your uploaded photos, generated content, and associated data (including any face data) are permanently deleted from our servers within 30 days.

f. Your Control Over Face Data

You have complete control over your face data and photos:

  • Don't upload: You are never required to upload photos. Only upload photos you are comfortable sharing.
  • Delete individual results: You can delete any AI-generated photo or video at any time from within the app.
  • Delete your account: You can delete your entire Neverland account and all associated data at any time via Settings → Delete Account.
  • Request data access: You can request a copy of your personal data, including photos, by contacting us at privacy@tryneverland.com

g. Children and Face Data

  • Neverland is not intended for children under 13, and we do not knowingly collect face data from children under 13
  • Do not upload photos of children under 13
  • If we discover that we have inadvertently collected face data from a child under 13, we will delete it immediately

Summary: We collect and process photos containing faces solely to provide AI transformation services. Face detection occurs on your device. Uploaded photos are temporarily stored in secure cloud storage and automatically deleted within a few days after generation. Generated results are kept until you delete them. We do not use your photos to train public AI models, sell your data, or share it with advertisers.

6. Data Security

We use industry-standard safeguards to protect your data. However, no system is 100% secure.

7. Content Moderation and Safety

  • We review user-generated content to ensure compliance with our Content Policy
  • All style packs are curated by our team to prevent inappropriate generations
  • Content moderation is performed through automated systems and manual review
  • Violating content is removed, and repeat offenders may face account suspension

8. Data Retention

Images uploaded by users are retained only as long as necessary to provide the requested service and are automatically deleted after a limited retention period or when the user deletes their content.

  • Uploaded photos are retained for the duration needed to process your generation
  • Generated images and videos are stored until you delete them or your account
  • Account data is retained while your account is active
  • Upon account deletion, all personal data is removed within 30 days
  • We may retain anonymized usage data for analytics purposes

9. Age Requirements

Neverland is not intended for children under 13. We do not knowingly collect data from children.

  • Users must be 13 years or older to use the app
  • We do not knowingly collect information from children under 13
  • If we discover a user is under 13, we will terminate their account immediately
  • Parents who believe their child has provided information to us should contact us immediately

10. Your Rights

Depending on your location, you may have the right to:

a. Access & Portability

  • Request a copy of your personal data
  • Export your generated content
  • Review what data we have collected

b. Correction & Deletion

  • Update or correct your account information
  • Delete specific content or your entire account
  • Request erasure of your personal data (subject to legal obligations)

c. Opt-Out Rights

  • Disable analytics tracking (limited functionality may result)
  • Unsubscribe from marketing emails
  • Opt out of non-essential data collection

11. International Users

  • Your data may be transferred to and processed in countries other than your own
  • We comply with applicable data protection laws (GDPR, CCPA, etc.)
  • If you are in the EU/EEA, we rely on standard contractual clauses for data transfers
  • California residents have specific rights under CCPA (see section 10 above)

12. Third-Party Services

We use the following third-party services to operate our app:

  • Clerk - Authentication and user management
  • Supabase - Cloud storage for images and videos
  • RevenueCat - Subscription management
  • Mixpanel - Analytics and usage tracking
  • AI Providers - Image generation services

Each service has its own privacy policy. We encourage you to review them.

13. Do Not Track Signals

Some browsers have "Do Not Track" features. At this time, we do not respond to DNT signals. However, you can:

  • Disable analytics in your account settings (when available)
  • Use device-level privacy controls
  • Contact us to opt out of non-essential tracking

14. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be effective when posted.

  • We will notify you of significant changes via email or in-app notification
  • Continued use of the app after changes constitutes acceptance
  • The "Last Updated" date at the top reflects the most recent version
